Kyabazinga wedding suit: Things turn against lawyer Mabirizi but he remains defiant

JINJA. Controversial lawyer Male Mabirizi has vowed to defy police summons requiring him to appear before the criminal investigations department (CID) over his recent bigamy case against Busoga king William Nadiope.

“I will not attend because the takeover of my criminal case by Jinja resident state attorney was premature and unconstitutional which will be set aside,” said Mabirizi.

Mabirizi last year on November 20 instituted private prosecutions against Kyabazinga, his wife Jovia Mutesi and some of the people who witnessed his wedding on November 18, 2023. According to Mabirizi, on the said date, at Christ Cathedral Bugembe being the scene of crime now, Nadiope, Mutesi, Archbishop of Church of Uganda Stephen Kazimba Mugalu and Buganda kingdom queen Sylvia Nagginda participated in, officiated and witnessed a ceremony of marriage well aware that it was invalid, criminal and void. 

This, he states, is because Nadiope had reportedly earlier contracted marriage before the registrar of marriages in England with Alison Anna in December 2016 at Mildam House Bunbaby Road, Portsmouth in the UK.

He thus levied different charges including fictitious marriage, bigamy, marriage with a person previously married, unlawfully performing a marriage ceremony and conspiracy to commit felonies against Kazimba and Nagginda.

He prayed for criminal summons to be issued against the listed individuals such that they can appear in court, charges be read to them, convicted and sent to prison to serve their respective sentences. The director of public prosecutions (DPP) has since taken over the criminal proceedings of the case. 

“The DPP to whom the police is the investigative body, have reason to believe that you have valuable information/exhibits /documents to assist police investigations in a case of fictitious marriage, bigamy and other charges…You are therefore required to report to Kira Central Division -Jinja Central police station to the office of the Divisional CID on Tuesday the 13th of February 2014 at 1100 hours,” reads the summon.

Mabirizi is required to report to Detective Assistant Superintendent of Police Evelyn Anyango.
