										<content:encoded><![CDATA[<p>KAMPALA &#8212;<strong> A Ugandan court on Friday sentenced Agnes Nandutu, former state minister for Karamoja affairs, to four years in prison for misusing public resources.</strong></p>
<p>The Anti-Corruption Court, sitting in the capital, Kampala, also barred Nandutu from holding any public office for 10 years.</p>
<p>Nandutu was convicted for her role in the diversion of 2,000 iron sheets intended for vulnerable communities in the semi-arid northeastern region of Karamoja.</p>
<p>Before the ruling, the former state minister pleaded for leniency and forgiveness.</p>
<p>Nandutu is among several senior government officials, including ministers, who were charged with diverting iron sheets meant for the Karamoja region for personal use. ■</p>

										<content:encoded><![CDATA[<p>KAMPALA. Four police officers from the Flying Squad Unit, Kireka based Police have been remanded to prison over allegations of robbing a businessman of gold valued at over Shs 380 million.</p>
<p>The accused officers are Detective Superintendent James Besigye Kiguuya, Detective Corporals Simon Owona, Pracid Mulangira, and Officer Monday Tibaijuka.</p>
<p>According to prosecutors, the officers allegedly stole one kilogram of gold worth $105,000 and $1,000 in cash from businessman John Vian Tumukunde on May 9, 2025, at Solent Avenue in Nakawa Division.</p>
<p>The suspects reportedly used firearms and other deadly weapons during the robbery, and the prosecution claims they had planned the crime in advance.</p>
<p>On Tuesday, the case was mentioned before Grade One Magistrate Frank Namanya, who remanded the officers until July 16, 2025, to allow for further investigations.</p>
<p>Prosecution led by Martin Odong Awiny requested an extension due to the magistrate&#8217;s absence and the need for additional investigations.</p>
<p>The matter, being capital in nature, will be transferred to the High Court. The four officers face charges of aggravated robbery and conspiracy to commit a felony.</p>

<p class="wp-block-paragraph"><strong>Kampala socialite Nasser Nduhukire, aka Don Nasser has been charged with defilement and aggravated trafficking in children.</strong></p>



<p class="wp-block-paragraph">Nasser who is accused of defiling a 16-year-old girl appeared before Buganda Road Court this morning and was remanded to Luzira prisons until October 8, 2024.</p>



<p class="wp-block-paragraph">Nasser is co-accused with Promise Gatete.</p>



<p class="wp-block-paragraph">The were earlier denied bail as they await committal to High Court to face trial since their charges carry a maximum penalty of death.</p>

<p class="wp-block-paragraph"><strong>A state attorney attached to the justice ministry has been charged with 16 counts of corruption after he allegedly solicited for a shs100m bribe.</strong></p>



<p class="wp-block-paragraph">The Anti-Corruption Unit of State House worked with CID and the Office of the Director of Public Prosecutions to pin Sam Tusubira before arraigning him in court on Tuesday.</p>



<p class="wp-block-paragraph">“The accused while representing government in court, solicited for a bribe of UGX100M from a plaintiff who had sued the Ministry of Lands and the Attorney General for irregular cancellation of his title, in order to assist the victim get compensated,” the unit stated.</p>



<p class="wp-block-paragraph">“By time of his arrest he had received about UGX43M from the victim. He has been remanded until 19th August 2024.”</p>

<p class="wp-block-paragraph">KAMPALA: <strong>Martha Nkwanzi, a daughter to the late businessman Henry Katanga has been remanded to Luzira prison for allegedly destroying evidence in the murder of her father.</strong></p>



<p class="wp-block-paragraph">Nkwanzi surprisingly surrendered herself to Nakawa Chief Magistrate, Erias Kakooza on Wednesday afternoon.</p>



<p class="wp-block-paragraph">The same court on Monday issued a warrant of arrest against her after she was again a no-show in court.</p>



<p class="wp-block-paragraph">During the court session on Monday, the defence team, represented by McDusman Kabega, along with lawyers; Bruce Musinguzi and Jet Tumwebaze, stated that Nkwanzi is recuperating at Roswell Hospital following a childbirth.</p>



<p class="wp-block-paragraph">The prosecution, however, challenged the information presented, labelling it hearsay, and maintained the necessity of a warrant for Nkwanzi&#8217;s arrest citing repeated failure to appear in court without justifiable reasons.</p>



<p class="wp-block-paragraph">Court heard that on November 2, 2023, at Mubya Chwa II, Nakawa Division, Kampala city, knowing that diverse things at the scene of crime may be required in evidence in a judicial proceeding, Nkwanzi and her other sister Patricia Kankwanzi removed or destroyed them or rendered them illegible or undecipherable or incapable of identification with intent thereby to prevent them from being used in evidence.</p>



<p class="wp-block-paragraph">The two daughters are jointly charged with their mother Molly Katanga who is reportedly admitted for injuries she allegedly sustained during the incident. Molly remains on criminal summons issued by the court requiring her to appear on January 22 to answer for her husband&#8217;s murder.</p>



<p class="wp-block-paragraph">The three family members are further indicted alongside the family&#8217;s shamba boy, George Amanyire and a medical practitioner, Charles Otai. Both men are charged with being accessories after the commission of murder when they allegedly assisted the widow and her two daughters to escape punishment yet they knew the trio were liable for an offence.</p>



<p class="wp-block-paragraph">Nkwazi through her legal team asked the court to allow her to take a plea in the charge. But that sparked off a lengthy argument after the prosecution side objected it. On Wednesday, amidst lengthy court proceedings, the prosecution led by state attorney Jonathan Muwaganya and Anna Kiiza objected to Nkwanzi taking plea, forcing court to take a break and resume later on.</p>



<p class="wp-block-paragraph">Muwaganya objected on grounds that Nkwanzi appears on the same charge sheet where the first suspect is charged with murder, which can only be tried by the High court. Muwaganya said plea-taking is a trial process where only a court with competent jurisdiction to try the matter can entertain the plea of the accused person.</p>



<p class="wp-block-paragraph">He asked the court to only communicate to the accused person the charges against her. Nkwanzi&#8217;s lawyers comprising McDusman Kabega, Ellison Karuhanga, and Bruce Musinguzi said that two days ago, the prosecution applied that their client be arrested to appear in court to take plea and prayed for a warrant of arrest hence there is no way they can start saying she shouldn&#8217;t answer to the charges when she has even brought herself to court.</p>



<p class="wp-block-paragraph">Kabega said the offence the court read to her prescribes the sentence not of life nor death, and therefore it is a misdemeanour that attracts seven years imprisonment once found guilty. As such, Kabega added that under Section 161 (1) of the Magistrates Court Act states that the court presided over by the chief magistrate which Kakooza is, may try the accused person unless the sentence attracts death, provided it&#8217;s for a custodial sentence.</p>



<p class="wp-block-paragraph">Kabega thus insisted that Nkwanzi takes plea for the offence. According to Kabega, the fact that she is on a charge sheet where the first suspect is charged with murder doesn&#8217;t in any way allow Nakawa Magistrates court jurisdiction to run away from trying this offence.</p>



<p class="wp-block-paragraph">He added that the prosecution has not provided court with any provisions of law where an accused person can be stopped from taking plea where the court has jurisdiction. To support his case, Kabega submitted that the other suspects on remand took plea before the same presiding magistrate, and that the prosecutors who are the very people who framed the charges were in court didn&#8217;t complain.</p>



<p class="wp-block-paragraph">But prosecutor Muwaganya insisted on his stand, saying the law stated by Kabega doesn&#8217;t address the question of several accused persons appearing on the same charge sheet with a mixture of capital and non-capital counts. Muwaganya said in this case, there is no explicit legal provision in the Magistrates Court Act that empowers the Magistrate&#8217;s court to entertain plea in one count on a charge sheet bearing a capital offence.</p>



<p class="wp-block-paragraph">He added that even this case has been registered in the capital offences register of court and given a capital offence number which all indicate that he has no jurisdiction over the matter. The prosecutor said the guidance of the High court in several cases has been that where offences are capital and others not capital, the jurisdiction of the gravest offence takes precedent over the other misdemeanours.</p>



<p class="wp-block-paragraph">According to Muwaganya, whereas plea was taken for the other accused persons, that exercise is subject to revision in the High court and the gist is to correct the exercise of plea-taking. He explained that as that matter is still pending in the High court, it is only right and proper and prudent that they await the guidance of the High court before court can determine whether or not to ask the accused person to take plea.</p>



<p class="wp-block-paragraph">After a 2-hour break, Kakooza ruled that the court has jurisdiction to take plea. He said when other accused persons were arraigned before him, they took plea and the prosecution didn&#8217;t contest it. As a result, Nkwanzi took plea and denied the charges against her.</p>



<p class="wp-block-paragraph">Later, Kabega applied for bond saying the law provides that a person can be released on bond even without sureties, saying she is a mother of three children including a one-month-old, born shortly after the death of Katanga. On this, Kakooza said there is need to be consistent and since he has already been informed that the hearing of the criminal revision application by the DPP has already been fixed for Tuesday next week for hearing, it is proper for the outcome before he can go ahead with hearing the bail application for Nkwanzi.</p>



<p class="wp-block-paragraph">Now Nkwanzi joins Kakwanza, Amanyire and Otai on remand at Luzira prison as the widow Molly Katanga remains issued with criminal summons requiring her to appear in court on January 22, 2024, for last November&#8217;s murder of her husband Katanga. All the accused persons are expected to return to court on that day.</p>



<p class="wp-block-paragraph">Both the accused persons and the complainants in this case are well-connected to powerful people in the government. The families on Tuesday night reportedly met the president at State House who assured them that justice will be served in this case.</p>

<p class="wp-block-paragraph">KAMPALA: <strong>The former Managing Director of Uganda Railways Corporation, Stanley Sendegeya, has been remanded on charges of forgery and uttering false documents.</strong></p>



<p class="wp-block-paragraph">According to court documents, Sendegeya forged and presented fake documents before getting the railways’ topmost job.</p>



<p class="wp-block-paragraph">Sendegeya was arraigned before the Buganda Road Chief Magistrates Court and the charges read to him.</p>



<p class="wp-block-paragraph">Natasha Mariam, the State House Anti-Corruption Unit spokesperson, said Sendegeya was netted in an operation by the unit and the Criminal Investigations Directorate of the Uganda Police (CID) on November 22.</p>

<p class="wp-block-paragraph">“Sendegeya is accused of forging and presenting documents proving that he had the requisite academic qualifications for the position of managing director, which he did not,” Mariam said.</p>

<p class="wp-block-paragraph">Prosecution led by Judith Nyamwiiza said in July 2023, Sendegeya, a resident of Namugongo, Wakiso district, forged a curriculum vitae with intent to deceive, perpetuating that he held a master’s degree in business administration, which was not the case.</p>



<p class="wp-block-paragraph">“During the same month, he offered false information to a recruitment firm at Lumumba Avenue named Delloit Uganda Ltd,” Nyamwiiza said.</p>



<p class="wp-block-paragraph">He was remanded until November 27.</p>

<p class="wp-block-paragraph">The duo spent Wednesday night in Luzira prison after being charged and remanded on eight counts of corruption. Bako appeared on all cases while Nvanungi faces one count which she allegedly committed when she was deployed in Sembabule as a Chief Magistrate.</p>



<p class="wp-block-paragraph">The Court has heard that during the month of April 2023, in Masaka City and Sembabule District, being a public official employed by the Government of Uganda as State Attorney in charge of the Resident State Attorney’s Office Sembabule and Chief Magistrate of Sembabule Chief Magistrates Court respectively in performance of their public functions solicited for gratification of 2.5 million shillings from the relatives of John Ambasize who was on remand on Ntusi CRB 034/2022 in exchange for his release on bail.</p>



<p class="wp-block-paragraph">The prosecution says that during the same month, Bako solicited 2.5 million shillings from Zedakai Karinti also in exchange for bail when he was facing criminal summons in a case arising from the same file number and she allegedly received 1.48 million shillings from Franco Mulangwa as part of the offer.</p>



<p class="wp-block-paragraph">Jacqueline Bako is also accused of soliciting 10 million shillings from Zedekiah Karintu in exchange for excluding him from the charge sheet where he had been charged with attempted murder, criminal trespass, and malicious damage to property. She allegedly received 7 million shillings.</p>



<p class="wp-block-paragraph">She further allegedly solicited and accepted 2 million shillings from the relatives of Eric Sabiiti who is an accused on the same file to release him on bail. They appeared in court on Thursdays and applied for bail.</p>



<p class="wp-block-paragraph">Jacqueline Bako presented her brother Francis Ayuko a brother, Dorcus Ndukuka her sister, and Raymond Odonga a close family friend as her sureties. &nbsp;She said she has been a State Attorney for 12 years and she therefore understands her obligations when granted bail.</p>



<p class="wp-block-paragraph">Sylvia Nvanungi presented Robert Muwangula her brother, and Prosper Martin Turyagenda, a cousin as her sureties.</p>



<p class="wp-block-paragraph">Nvanungi said she is sickly and has been undergoing treatment right from October 27th, 2023 &nbsp;to date, and that during the time of her arrest, she lost her valuables including her work ID and others, two medical forms submitted showing she suffers from peptic ulcers and allergy.</p>



<p class="wp-block-paragraph">She has been a Judicial officer for the past eight years and is an ordinary resident of Kulabiro- Kisasi Nakawa division which is within the jurisdiction of the court. Through their lawyers, they told the Court that the charges against them were bailable.</p>



<p class="wp-block-paragraph">However, the Prosecution led by Stanley Baine had opposed the application saying the offenses which the applicants were charged with must be taken into consideration because they are serious in nature and attract heavy punishments upon conviction and therefore they may abscond from trial.</p>



<p class="wp-block-paragraph">He had demanded that the court impose stringent bail against the accused persons as well as their sureties.</p>



<p class="wp-block-paragraph">The magistrate however dismissed the submissions of the Prosecution describing them as baseless since he had not demonstrated how severe the punishments were. She said the submissions had no merit and went ahead to grant State Attorney Bako 1.5 million shillings bail and each of her sureties 50 million shillings not cash.</p>



<p class="wp-block-paragraph">Nvanungi was granted bail of 800,000 shillings cash and her sureties 40 millionn shillings not cash.</p>



<p class="wp-block-paragraph">The trial magistrate warned that in case of the accused persons don’t show up, the sureties should be able to appear.&nbsp; The accused were further warned that they risk being issued with criminal imprisonment if they absconded.</p>



<p class="wp-block-paragraph">She further cautioned them that if the accused persons become stubborn, their sureties should surrender them to court and they shouldn’t stop them from doing their roles as a surety. She has adjourned to January 19th, 2024.</p>
